Case#1 - Adequacy of Construction Documents
A general contractor entered into a contract with a South Florida county to construct a $10 million cruise ship terminal. It was a complex project involving phasing the work around the cruise ship season in an active port. During the 12-month schedule, the contractor was forced to submit literally hundreds of requests for additional information to the Architect. After completion of the project, Dart was employed by the contractor to provide a professional opinion on the adequacy of the original construction documents.
Case #2 - Cost Evaluation of Hurricane Insurance Claim
The Owner of a 200-room motel employed Dart to prepare a cost estimate to make repairs caused by a hurricane in 2004. The insurance company's adjuster estimated the cost of repairs at less than $3 million. Dart's estimate was twice that amount.
Case #3 - Cost Evaluation of Termite and Water Damages - Case Won By Orkin
Over the last few years, one of the nation's largest termite control companies has employed Dart to assist them in defending several significant claims for the cost of repairing termite damage to buildings which they had treated. Case #4 - Engineering Negligence
A family contracted to have a custom home built on their lot in Mt. Dora. Upon completion, the property did not drain properly and often flooded. Dart was employed by the family to provide expert opinions on the performance of both the contractor and the subdivision's engineer of record.
Case #5 - Cost to Complete a New Building
A church in Sanford embarked on a program to develop a new multi-purpose building on its property. When the building was 70% complete, cost overruns forced the church into bankruptcy. With the approval of the United States Bankruptcy Court, Dart was engaged to determine the cost to complete the construction of the building and to resolve issues with the construction permit as well as compliance with the Florida Building Code.
Case #6 - Building Code Compliance
In 2001, a wealthy retiree contracted with a general contractor to build a custom home worth well over a million dollars. After completion, the Owner complained that key elements of the home did not comply with the Code. The contractor's attorney recommended to the contractor that Dart be engaged to provide expert opinions on the code compliance and overall quality of the finished residence.
Case #7 - Owner Representative Professional Negligence
An Architect was employed by a limited partnership to act as both the Architect-of-Record as well as the Owners Representative on a $20 million high rise office building in Naples, Florida. The project was completed 2 years late and several million dollars over budget. Dart was hired by the partnership as a consultant to assist in asserting a claim against the Architect for both professional negligence and breach of contract. Case #8 - Eminent Domain
The Florida Department of Transportation recently took possession of nearly an acre of a parking lot which serviced a major office building in downtown Orlando. The property was needed to expand the East-West Expressway. Dart was engaged by the office building's Owner to evaluate the cost impact to cure the damage done to the parking lot by the take. This is Dart's fourth eminent domain case with the law firm of Holland & Knight. |
